In order to disseminate legal knowledge in the field of notarial law to the public, the Master’s Program in Notarial Law at the UGM Faculty of Law uploaded “Three Minute Thesis #4” on August 20, 2025, to its Instagram account @notariatlaw.ugm and YouTube channel “Magister Kenotariatan FH UGM.” “Three Minute Thesis” is a video summarizing the results of students’ final thesis research. The first Three Minute Thesis #4 featured the thesis titled “Implications of Differences in the Form of Deeds of Inheritance Rights Issued by Notaries in Yogyakarta City on the Transfer of Land Rights” by Tiyas Putri Megawati, with Dr. R.A. Antari Innaka Turingsih, S.H., M.Hum., serving as her thesis advisor.
This study is based on the premise that a certificate of inheritance is an authentic deed drawn up by a notary as the basis for the transfer of land rights; however, in the City of Yogyakarta, notaries hold differing views regarding the form of the deed—whether it should be an “ambtelijk acta” or a “partij acta”—which has led to legal uncertainty due to the absence of clear regulations. This background gives rise to two research questions: (1) What are the implications of the differences in the forms of inheritance rights certificates issued by notaries in the City of Yogyakarta on the transfer of land rights?; and (2) What is the ideal form of an inheritance rights certificate that ensures fairness and benefits for all parties?
This study found that differences in the form of inheritance certificates—whether “partij acta” or “ambtelijk acta”—do not affect the transfer of land rights as long as witnesses are listed. However, the “partij acta” is considered more ideal because it places responsibility on the parties involved, can be amended via an addendum, and is fairer and more beneficial to heirs compared to the “ambtelijk acta,” which instead places full responsibility on the notary.
The Three Minute Thesis is a concrete manifestation of the commitment of the administration and students of the Notarial Studies Master’s Program at the UGM Faculty of Law to improving the quality of education, which is the fourth point in the Sustainable Development Goals (SDGs). This is achieved through efforts to disseminate legal knowledge in the field of notarial law so that the public can better understand the proper form of deeds certifying inheritance rights, thereby ensuring that the rights of heirs are protected and that the land transfer process maintains legal certainty.
