On Tuesday (November 26, 2024), the Master’s Program in Business and Public Law (MHBK) at the Faculty of Law, Gadjah Mada University (UGM), held a national seminar titled “Amendments to the Patent Law: Responding to Changing Times, Technological Advancements, and the Need for Patent Commercialization in Indonesia.” The event, held in the Auditorium of Building B at the UGM Faculty of Law, featured a number of expert speakers in the field of intellectual property law.
This seminar was organized to discuss significant amendments to Law No. 65 of 2024 on Patents, which was passed during a plenary session of the Indonesian House of Representatives (DPR RI) on September 30, 2024.
Several key changes were discussed. Some of these relate to the addition of new definitions for “Traditional Knowledge” and “Genetic Resources,” updates to provisions regarding non-patentable inventions, the extension of the grace period from six months to one year, refinements to compulsory licensing rules and substantive patent reexamination, as well as regulations governing patent applications related to the use of genetic resources and traditional knowledge in accordance with the World Intellectual Property Organization (WIPO) Treaty on Genetic Resources Related to Traditional Knowledge (GRTK).
Acara ini diselenggarakan dengan bekerja sama dengan Asosiasi Pengajar Hak Kekayaan Intelektual (APHKI), Center for Intellectual Property, Competition and Dispute Settlement Mechanism Studies (CICODS), dan Departemen Hukum Bisnis Fakultas Hukum UGM.
Seminar nasional ini menghadirkan narasumber yang kompeten di bidangnya. Wakil Menteri Koordinator Hukum, HAM, Imigrasi, dan Pemasyarakatan yakni Prof. Dr. Otto Hasibuan, S.H., M.H. menjadi narasumber utama. Selain Otto Hasibuan, hadir pula Dra. Sri Lastami, S.T., M.IPL. yang merupakan Direktur Paten, DTLST, dan Rahasia Dagang Direktorat Jenderal Kekayaan Intelektual (DJKI), Prof. Dr. Ahmad M. Ramli, S.H., M.H., FCBArb selaku Pembina APHKI dan Guru Besar Fakultas Hukum Universitas Padjadjaran, dan Prof. Sang Kompiang Wirawan, S.T., M.T., Ph.D., sebagai Sekretaris dari Direktorat Pengembangan Usaha UGM. Seminar ini dihadiri oleh berbagai jenis peserta yang meliputi akademisi, praktisi hukum, mahasiswa, dan perwakilan dari berbagai perguruan tinggi dan instansi terkait di wilayah Daerah Istimewa Yogyakarta dan sekitarnya.
This seminar is closely linked to one of the Sustainable Development Goals (SDGs), specifically Goal 9 on Infrastructure, Industry, and Innovation. The event also plays a role in contributing to the advancement of innovation in Indonesia. Through these improvements to patent regulations, Indonesia is striving to create an innovation ecosystem that supports technological development, research, and various other innovations. This seminar on amendments to the Patent Law is expected to provide a deeper understanding of intellectual property rights protection in support of innovation and technological development in Indonesia.
