The Department of Islamic Law, in collaboration with the Sleman Religious Court, successfully conducted the sixth installment of its collaborative Legal Outreach series on Friday, May 27, 2022. The session centered on the theme "Divorce and Its Legal Issues in Practice."
The first speaker, Dr. Khotibul Umam, S.H., LL.M. (lecturer, Department of Islamic Law, FH UGM), examined the foundational principles of matrimony through the lens of the Compilation of Islamic Law (Kompilasi Hukum Islam) and national marriage legislation. He noted that while marriage is intended to foster enduring happiness, divorce may be pursued as a legal remedy when such objectives become unattainable. Beyond exploring the nature and intent of marriage, Dr. Khotibul Umam addressed the legal grounds for dissolution, the various classifications of talak (divorce initiated by the husband), and the legal consequences resulting from the termination of the marital bond. The second presentation featured Drs. Nurudin, S.H., M.Si., a Judge at the Sleman Religious Court, shared insights into the practical realities of the judicial system. His discussion touched upon legal issues frequently encountered in divorce proceedings, including reconciliation rights (rujuk), child custody arrangements, and the division of marital assets. He further noted that while the Religious Court oversees numerous petitions, the institution prioritizes preventive measures—such as public education and mediation—to reconcile spouses before proceedings advance. He expressed hope that academic institutions would continue to support efforts to address the societal challenges posed by increasing divorce rates.
The gathering drew more than 50 attendees, representing a diverse audience of academics and practitioners, including lawyers, notaries, and officials from the Office of Religious Affairs (KUA). The outreach session was conducted via Zoom and broadcast live through the FH UGM Knowledge Channel (Kanal Pengetahuan Fakultas Hukum UGM).
