The High Prosecutor's Office of the Special Region of Yogyakarta (Kejaksaan Tinggi DIY), in partnership with the Faculty of Law, Universitas Gadjah Mada (FH UGM), conducted the inaugural session of the Datun Suluh Praja legal outreach program on Tuesday, July 26, 2022. Held in person at the Maguwoharjo Village Hall, the assembly was attended by approximately 35 village officials and featured two expert speakers from FH UGM: Rafael Edi Bosko, S.H., M.IL., and Dr. Djoko Sukisno, S.H., C.N.
The proceedings commenced with opening remarks from the FH UGM Vice Dean for Research, Community Service, and Information Systems, Dr. Heribertus Jaka Triyana, S.H., M.A., LL.M. In his address, he characterized the program as a foundational milestone for the Faculty's series of community engagement initiatives. Further remarks were delivered by Kristanti Yuni Purnawanti, S.H., M.H., in her capacity as Assistant for Civil and State Administrative Affairs at the DIY High Prosecutor's Office, and Kasidi, the Head of Maguwoharjo Village.
The seminar featured two presentation segments. The first session was led by Dr. Djoko Sukisno, S.H., C.N., who spoke on Legal Aspects of Land Tenure in the Special Region of Yogyakarta. He outlined that land ownership within the region is categorized into private holdings and land owned by the Sultanate or the Duchy (Sultan Ground and Pakualaman Ground), noting that Sultanate land remains available for third-party utilization, including for village-level interests. Village administrations have been granted anggaduh rights over village land, which encompasses village treasury land (tanah kas desa), palungguh land, and pangarem-arem land. While governed currently by Governor Regulation No. 34 of 2017, Dr. Djoko noted that an upcoming revision is expected to introduce significant changes regarding replacement land. Under the proposed framework, if replacement land is not secured within a two-year window, compensation funds would be transferred to the Sultanate as the legal owner to assume responsibility for land acquisition, rather than being retained by the village. He further explained that the draft regulation intends to permit holders of palungguh and pangarem-arem rights to establish partnerships with third parties through build-transfer-use schemes or lease agreements, provided they adhere to village regulations. This proposed shift is designed to alleviate the administrative complexities faced by village governments regarding land replacement.
The second segment was delivered by Rafael Edi Bosko, S.H., M.IL., covering National Land Law. He examined the definition of land under the Basic Agrarian Law (UUPA), which characterizes land as the earth's surface. The law also extends this scope to include the airspace above and the subsurface beneath, provided these elements are directly connected to the land's practical use. Rafael also underscored the necessity of registering land with local authorities. He stated that land registration is vital for providing legal certainty to owners, ensuring legal protection for third parties, and fostering an orderly system of land administration.
Following the presentations, the program moved into an interactive Q&A segment. Village officials actively participated by raising various social challenges and legal issues encountered within their communities. Representatives from both FH UGM and the DIY High Prosecutor's Office engaged in these discussions, providing expert insights into the legal dimensions of the cases presented.
As the gathering concluded, village officials expressed their appreciation and voiced a strong desire for continued legal outreach activities, hoping the program would lead to future collaborative sessions.
