Democracy and Human Rights Study Centre (PANDEKHA) had successfully held the Research Meeting on Friday (13/9/2024). The event took place in the Research Centre Faculty of Law UGM was one of the part of the mentoring process from the Students' Research Grant program. With the theme of “Judicial Law”, this event presented external reviewer, Binziad Kadafi, S.H., LL.M., Ph.D., the Judicial Commission member and a lecturer from Sekolah Tinggi Hukum (STH) Indonesia Jentera (Jentera Law School).
In this event, four young researcher from Undergraduate to Doctoral level presented their research progress to receive constructive feedback from the external reviewer.
Aditya Muhammad Bintang opened the session with a presentation entitled “Legal Enforcement Issue Towards Child Labor in Informal Sector: Case Study on Mount Merapi Sand Mining in Cangkringan District". Binziad Kadafi gave a feedback regarding sharpening the research focus for prioritizing civil, criminal, or administrative weaknesses in oversight aspects. Kadafi also emphasized the importance of a case-based approach based on court decisions, so that legal issues can be mapped more clearly and with greater focus.
Next, Kenley Wijaya presented his research, "Efforts to Rebuild Ethical Integrity: Obstacles and Complexities of Establishing an Ethics Court in the Indonesian Judiciary." Kadafi's input focused on the scope of ethical violations and the urgency of establishing a judicial ethics institution. In addition to exploring the post-reform institutional dynamics, Kadafi emphasized the importance of an analysis encompassing both the procedural and material aspects of the proposed ethics institution.
The third study, presented by Muhammad Raihan Sjahputra, addressed the topic When Judgments Read Like Tea Leaves: The Case for Intelligibility of Indonesian Judicial Decisions. Kadafi suggested that the study focus on criminal cases, given the stricter judicial review in this area. Raihan also recommended using a sociolegal approach to compare the workload of judges in Indonesia with that of other countries, in order to provide a fairer perspective in assessing the quality of judicial deliberations.
Finally, Gunawan A. Tauda presented his research, "The Meaning of Majority Opinions of Judges in Determining Constitutional Court Decision-Making (Study of Decision Number 90/PUU-XXI/2023). Kadafi appreciated this research and suggested that Gunawan conduct further research into the practice of concurring opinion and dissenting opinion in the Supreme Court and other judicial bodies. A comparative approach is also considered to enrich the research perspective.
This Research Meeting is expected to improve the quality of research within the UGM Faculty of Law student body and strengthen the foundation of the Indonesian judiciary. This initiative aligns with the commitment to the Sustainable Development Goals (SDGs), particularly point 4 on Quality Education and point 16 on Peace, Justice, and Strong Institutions .
