The Faculty Of Law, UGM, Conducts Legal Education To The Public Through A Public Education Broadcast On The Reposition Of The Reasons For Expunging Criminal Convictions In The National Criminal Justice Process

Yogyakarta, April 1, 2026 – Faculty of Law, Gadjah Mada University through the Center for Consultation and Legal Aid (PKBH) and Radio Republik Indonesia (RRI) Pro 2 Yogyakarta successfully carried out a legal counseling broadcast as part of the 2026 community counseling grant program organized by PKBH with the topic "Casual Afternoon: Repositioning the Reasons for the Abolition of Criminal Law in the National Criminal Justice Process". This broadcast was held to provide insight to the public regarding the reasons for the abolition of criminal law as regulated in the Criminal Code (KUHP) Number 1 of 2023 which was just ratified on January 2, 2026. This activity is a concrete step by PKBH FH UGM in educating the public regarding the reasons for the abolition of criminal law.

This broadcast presents Hauzan Zaky Rizqullah S.Tr.K as PS. Head of Unit II of the Sleman Police Criminal Investigation Unit and Lukas Putra Eugara, S.H. as a Masters Student in Litigation Law at Gadjah Mada University as the main speakers.

This discussion highlights the reasons for the elimination of criminal offenses in the new Criminal Code, specifically discussing the justification and forgiveness reasons in the investigation and inquiry stages. Hauzan Zaky Rizqullah S.Tr.K as a resource person who has experience in conducting investigations and inquiries conveys that the reasons for the elimination of criminal offenses are divided into two, namely justification reasons, reasons that justify the act and forgiveness reasons, reasons that forgive mistakes, He continued, whether this reason can be used in the investigation stage, it is necessary to know first that the level of investigation work is related to alleged criminal acts so that to declare an act as a criminal act is the authority of the judge so that according to him, justification reasons may be used in the investigation stage but it depends on the context whether there is an element of unlawful written if it is not written then it is not the authority of the investigator while the reason of forgiveness cannot be used because the guilt needs to be proven first. Furthermore, Lukas Putra Eugara, S.H. reiterated the justification and excuses in the new Criminal Code, specifically the excuses that have provided certain limitations for children and people with disabilities.

Both speakers highlighted that the justification for criminal amnesty can provide benefits for people who are fighting for justice. Hauzan Zaky Rizqullah S.Tr.K also offered a quote to people who are facing the law, "It's wrong to hope in humans. It's better to hope in God."

The broadcast that has been implemented is a concrete step that supports the Sustainable Development Goals (SDGs) and a form of community service. This activity directly contributes to SDGs point 4 concerning quality education by increasing legal literacy for the wider community regarding the Repositioning of Reasons for the Elimination of Criminal Law. In addition, this activity also supports SDGs point 16 concerning Peace, Justice, and Resilient Institutions by spreading legal understanding to form a peaceful, just and resilient society and of course not only that, this program also supports the achievement of SDGs agenda point 17 related to Sustainable Development regarding collaborative synergy between various institutions.
