DIALEKTIKA #4: “War Crimes and Humanitarian Issues by Israel Towards Palestine”

ALSA LC UGM recently just provided the informal law forum for their members through DIALEKTIKA by Law Development Division under their function for research development and publication. DIALEKTIKA presented to increase the members’ skill for a critical thinking, delivering their opinion, and discussing in an informal discussion forum. DIALEKTIKA #4 was held on Wednesday (13/03/2024) with bringing the topic “War Crimes and Humanitarian Issues by Israel towards Palestine”. This topic was brought as a response to the current international legal issue.

This discussion was started from the introduction of the history and facts from the Israel and Palestine conflict that took place since the 20th century. Over time, the conflict continued until 7th of October 2023, Palestinians finally carried out a massive resistance led by Hamas. In response, Israel carried out indiscriminate attacks even though the hostages had been returned to the Israeli side. Several hospitals were even destroyed, making access to health services very difficult to reach. The Palestinian people were forced to move and secure themselves in the Rafah area which was still being attacked and bombed by Israel.

Several ways have been done by other countries to stop Israel's attacks on Palestine. Not only the UN and countries are trying to stop Israel, but also the BDS(Boycott, Divestment and Sanctions)movement has emerged from the community to boycott brands known to fund Israel. South Africa even took the case to the International Court of Justice (ICJ), but it has not produced significant results.

During the discussion, the participants expressed their opinions on the occurring conflict. The participants were discussing on the genocide violation by Israel to Palestine as a conflict in the international council that has not yet find a resultion spot for the Palestinians.

Syabilla Himaningtyas and Zaidan Chanif Alfarizi argue that various draft solutions to the conflict have often been submitted and embedded as a form of settlement efforts, such as submitting a ceasefire. However, the execution of Israel's ceasefire has also become a matter of debate, due to the use of veto rights by the United States which rejected the implementation of the ceasefire. In addition, the ICJ did not explicitly order Israel to carry out a ceasefire and was unclear in describing its mechanism so that the meaning of the decision is still gray.

Samuel Ferian Bonay also argued that on the other hand, people in various countries have made efforts to boycott brands of products that still have ties to Israel. This mass boycott, which has proven effective, was carried out to cut off war funding obtained from the profits of pro-Israel companies, as well as a form of support for Palestine.

The discussion session ended with the conclusion that the community needs to play an active role in creating public intelligence, one of which is through social media. This aims to increase the sense of issue from the community and the series of solidarity towards Palestine can continue to roll.
