Law No. 11/2020 on Job Creation (UUCK), in conjunction with Government Regulation No. 64/2021 on the Land Bank Agency (PP BBT), establishes the Land Bank Agency as a legal entity formed by the central government, holding special authority over land management and answering directly to the President — making it a legal entity of a unique, standalone kind (sui generis).
The regulatory framework for the Land Bank under the UUCK and PP BBT raises several crucial issues that need clarifying if the Land Bank's goal of achieving a just economy is to be realized. A just economy can't be separated from equitable development — one that's proportional in nature but still tilts in favor of groups with weaker bargaining positions. Proportionality becomes especially important given that the Land Bank Agency's objectives aren't tightly specified, and its functions risk becoming disproportionate if activities aren't well-planned and transparent, carried out with due caution, and properly accounted for. Since the Agency's governance structure hasn't yet been spelled out in detail within PP BBT, a lack of clear guardrails could create risk of "institutional corruption." Striking a balance between land supply and distribution for investment purposes versus the public's interest becomes critical.
This webinar was organized by FH UGM as part of an effort to monitor the Land Bank Agency's existence and operations, with the aim of achieving a just economy through land supply and distribution that serves public welfare.
