In order to disseminate legal knowledge in the field of notarial law to the public, the Master’s Program in Notarial Law at the UGM Faculty of Law once again posted “Three Minute Thesis #2” on August 2, 2025, on its Instagram account @notariatlaw.ugm and YouTube channel “Magister Kenotariatan FH UGM.” “Three Minute Thesis” is a video summarizing the findings of students’ final research projects (theses). This time, the Three Minute Thesis featured the thesis titled “Interpretation of Scenic Views as an Element of Enjoyment of Property and the Role of Notaries in Providing Legal Protection for Parties in Lease Agreements for Scenic Views in Gianyar Regency, Bali Province” by I Wayan Bagus Perana Sanjaya, with Dr. R.A. Antari Innaka Turingsih, S.H., M.Hum., as the thesis advisor.
This research stems from the premise that others’ perspectives can determine what is permissible and impermissible regarding land—more specifically, the view that serves as the subject of the lease—in Gianyar Regency, Bali Province. The research questions in this study are: (1) How is a view interpreted as an element of enjoyment of a property in view lease agreements in Gianyar Regency, Bali Province?; and (2) What is the role of a notary in providing legal protection for the parties involved regarding the formulation of a view as an element of enjoyment of a property in view lease agreements in Gianyar Regency, Bali Province?
The findings of this study introduce two new paradigms in lease agreement law: first, that the interpretation of “view” is not limited to the physical landscape of the leased land but also encompasses contextual activities on it—such as agricultural activities—which can shape the enjoyment itself in accordance with the parties’ contractual freedom. This expands the conventional understanding that the enjoyment of a thing is not merely absolute based on the essence of the object, but is also relative, depending on the context and the parties’ perceptions, thereby enriching the civil law doctrine regarding the right to enjoy a thing. This study also found that landscape lease agreements are often formalized in notarial deeds, where the notary’s role is not merely administrative but also that of a legal innovator who precisely formulates contractual norms, prevents oversimplification, and ensures clarity, mitigates the risk of disputes, and provides external legal protection as the foundation for the creation of strong internal legal protection.
The Three Minute Thesis demonstrates the commitment of the administration and students of the Master of Notary Program, Faculty of Law, Universitas Gadjah Mada, to improving the quality of education, which is Goal 4 of the Sustainable Development Goals (SDGs). This is achieved through efforts to disseminate legal knowledge in the field of notarial practice, specifically to help the public be more discerning and better protected when entering into lease agreements, as well as to understand the importance of the notary’s role in providing legal certainty and preventing disputes.
