Anas Puji Istanto, S.H., M.H., has finished his public doctoral defense in Faculty of Law UGM with the research entitled “Norm Conflict Resolution in Regulation of Losses Due to Business Risks of State-Owned Enterprises in the Form of Limited Liability Companies According to the State Finance Law”. This public doctoral defense was conducted on Tuesday (30/07) in Room 3.1.1. Faculty of Law UGM. On this public doctoral defense, Dahliana Hasan, S.H., M.Tax., Ph.D. acted as the Chief Examiner, Dr. Marcus Priyo Gunarto, S.H., M.Hum. as the Promoter, Dr. Sulistiowati, S.H., M.Hum. as the co-Promoter, and the Examiner Members consisting of Prof. Dr. Nindyo Pramono, S.H., M.S., Dr. Supriyadi, S.H., M.Hum., Dr. Mailinda Eka Yuniza, S.H., LL.M., and Prof. Dr. Drs. Prasetio, Ak.CA., S.H., M.Hum., (PT Garuda Indonesia Tbk).
In this doctoral defense, Anas explained regarding the concept of the public and private law and the corridors of it in the field of SOEs. For the public law sector, as what mentioned in the dissertation, is regarding the dividend that includes the state finance and state rights, along with the shares and tax. Then regarding private law, namely the occurrence of many losses which, when linked to business activities, are proven by several parameters—one of which is the absence of fault and the absence of malicious intent—then such matters fall under business risks as regulated in civil law. SOEs is prioritizing the public law due to the public order, that specifically connected with BUMN as public interest, therefore public law can be enforced as what it should be, however, according to integrative theory, its implementation has its own corridors and limitations.
In this public doctoral defense, Anas successfully defended his research and was declared graduated with an A grade. It is hereby announced that Anas Puji Istanti, S.H., M.H. has officially becoming the 272nd Doctor to passed the doctoral examination from Faculty of Law UGM and the 6295th Doctor that have graduated from Universitas Gadjah Mada.
