On Monday (October 16, 2023), Herliana, S.H., M.CommLaw, Ph.D., a faculty member at the UGM Faculty of Law who received an External Legal Outreach Grant, together with Dr. Rimawati, S.H., M.Hum., conducted a legal outreach session on the topic “Optimizing Mediation to Resolve Disputes in Support of Building a Smart City.” The event took place at Bethesda Hospital and was attended by members of the executive board, doctors, nurses, the public relations department, and the legal division.
The presentation began with an explanation of the obligations of medical personnel, namely the duty of care and the duty of explanation. These obligations often lead to disputes if neglected, such as medical accidents, medical malpractice, and medical disputes. Should such incidents occur, the speakers explained that hospital management and medical staff will take steps to minimize greater losses, such as damage to the hospital’s reputation and public trust. Therefore, as a means of offering a win-win solution, mediation in medical disputes should always be prioritized. This is because mediation is a confidential dispute resolution method that avoids media scrutiny, is time-efficient, and is cost-effective.
Raising this topic through legal education is, in fact, one of the concrete efforts by the UGM Faculty of Law to achieve SDG Goal 3, “Ensure Healthy Lives and Promote Well-being for All at All Ages,” and SDG Goal 16, “Promote Peaceful and Inclusive Societies for Sustainable Development, Provide Access to Justice for All, and Build Effective, Accountable, and Inclusive Institutions at All Levels.” This legal outreach program highlights the importance of mediation as a means of dispute resolution to foster justice for all, in tandem with efforts to ensure healthy lives.
