Guest Lecture: "Qira'ah Mubadalah"

On Wednesday, November 17, the Master of Laws Program held another multidisciplinary guest lecture to enrich its Contemporary Family Law course. Opening the session, Sri Wiyanti Eddyono, S.H., LL.M.(HR), Ph.D., explained that Contemporary Family Law is a new course within the Master of Laws program, focused on the principles, foundations, theories, and legal developments surrounding marriage and inheritance in contemporary Indonesia, drawing on legislation, court rulings, and doctrine across both general civil law and Islamic law.

One notable concept within family law — particularly Islamic family law — is Qira’ah Mubadalah , which literally refers to a technique of reading texts by placing something in relation to its counterpart/equivalent. Qira’ah Mubadalah is intended as a possible method or perspective for lawmakers and/or law enforcers (the executive and judicial branches) in shaping family law policy — particularly regarding how well the mubadalah perspective aligns with existing positive law (ius operatum), how society interprets and applies relationships within family law in practice (ius operatum), and how family law regulation ideally ought to be structured going forward (ius constituendum). With that context, this guest lecture was themed "Qira’ah Mubadalah Its Relevance to the Development of National Family Law."

The lecture featured Dr. Faqihuddin Abdul Kodir (Dr. Faqih), a lecturer in Hadith Interpretation at IAIN Syekh Nurjati Cirebon. The session ran for 100 minutes, from 1:00 PM to 2:40 PM. Throughout, Dr. Faqih explained Qira’ah Mubadalah from an Islamic perspective and its application within society. His presentation drew strong engagement from participants, with questions touching on how Qira'ah Mubadalah should be constructed into law, and how it's been implemented in other societies and countries. Questions came from students, lecturers, and legal practitioners alike. Moderated by Dr. Khotibul Umam, S.H., LL.M., the session ran smoothly, with lively discussion between participants and Dr. Faqih. The event was livestreamed on the FH UGM Kanal Pengetahuan YouTube channel, with sign language interpretation provided.
