Research by Lecturers from the Department of Islamic Law, Faculty of Law, UGM at the Sayap Ibu Foundation in Yogyakarta regarding the Plurality of Arrangements and Care of Found Children (Anak Laqith) in Indonesia

Wednesday (28/8/2024) Lecturer from Department of Islamic Law Faculty of Law UGM, Dr. Hartini, S.H., M.Si., visited the Sayap Ibu Foundation Yogyakarta Branch. This foundation is located in Rajawali St. Number 3, Pringwulung, Condongcatur, Sleman. This visitation was conducted as part of research on Plurality of Regulation and Care of Found Children (Laqith Children) in Indonesia. It is important to know that Sayap Ibu Foundation is one of the institution that focuses on the care of the abandoned children and infants, included the children that found and had obtained an operational permit from the Ministry of Social Affairs of the Republic of Indonesia. Sayap Ibu foundation manages 3 units at the orphanage, which one one them is Panti 1, the unit that aims to take care of the abandoned children.

Penelitian yang dilakukan Dr. Hartini ini berusaha menjawab permasalahan penemuan bayi yang masih marak terjadi di masyarakat. Melalui penelitian ini, Dr. Hartini meninjau praktik pengangkatan dan pemeliharaan anak-anak temuan berdasarkan berbagai regulasi yang ada. Selain itu, penelitian ini dimaksudkan merumuskan skema dan konsep perlindungan hukum bagi anak-anak temuan, khususnya dalam hal identitas pribadi, termasuk hubungan nasab dan/atau hubungan keperdataan dengan orang tua kandungnya. Dilihat dari beragam regulasi yang ada, ternyata masih terdapat pluralitas pengaturan terkait hal itu sehingga memerlukan kajian yang lebih mendalam guna merekonstruksi aturan-aturan tersebut. Dalam perspektif hukum Islam misalnya, diatur secara ketat mengenai hubungan nasab anak dengan orang tua asalnya. Sebab hal tersebut berkaitan dengan maqashid al-syariah yaitu hifz al-nasb (pemeliharaan keturunan).

During the visit, Dr. Hartini met with Foundation administrators to discuss the practice of adopting children through foster care institutions. It turned out that the waiting list for adoption applications through the Yogyakarta Special Region Provincial Social Services Office was quite long. As of August 2024 alone, there were at least 80 registered prospective adoptive parents. Given this reality, Dr. Hartini's research certainly has the urgency to serve as recommendations for policymakers so that adoptions can be implemented in accordance with the principle of the child's best interests while still paying attention to efforts to protect and fulfill children's rights.
