National Seminar Organized by the Department of Business Law Discusses Patent Rights

On Tuesday (November 26, 2024), the Department of Business at the Faculty of Law, UGM, together with the Master’s Program in Business, Law, and Public Administration (MHBK), the Center for Intellectual Property, Competition, and Dispute Settlement Mechanism Studies (CICODS), and the Association of Intellectual Property Educators (APHKI) organized a seminar on patent law titled “Amendments to the Patent Law: Responding to the Changing Times, Technological Advancements, and the Need for Patent Commercialization in Indonesia?”

The seminar featured speakers from various institutions, including Prof. Dr. Otto Hasibuhan, S.H., M.H. (Deputy Coordinating Minister for Law, Human Rights, Immigration, and Corrections), Dra. Sri Lastami, S.T., M.IPL. (Director of Patents, DTLST, and Trade Secrets at DJKI), Prof. Dr. Ahmad M. Ramli, S.H., M.H., FCBarb. (Advisor to APHKI and Professor at the Faculty of Law, Padjadjaran University), and Prof. Sang Kompiang Wirawan, S.T., M.T., Ph.D. (Secretary of the Directorate of Business Development, UGM), with Laurensia Andrini, S.H., LL.M., Ph.D. (Chair of the Department of Business, Faculty of Law, UGM) serving as moderator.  

In their presentations, the speakers discussed the significant changes contained in Law No. 65 of 2024 on Patents, which reflect Indonesia’s efforts to align its patent system with national and international developments. Some key points in these amendments to the Patent Law include the addition of new definitions regarding “Traditional Knowledge” and “Genetic Resources,” updates to provisions concerning inventions that are not patentable, and the extension of the grace period from six months to one year, refinements to rules regarding compulsory licensing and substantive patent re-examination, and regulations governing patent applications related to the use of genetic resources and traditional knowledge. These changes represent Indonesia’s effort to align its legislation with the World Intellectual Property Organization (WIPO) Treaty on Genetic Resources Related to Traditional Knowledge (GRTK), which Indonesia has adopted.
