NATIONAL HEALTH LAW SEMINAR “Implications of the Referral System in the JKN Era for the Fulfillment of Patients’ Rights”

Health is a fundamental right that must be fulfilled so that individuals can carry out their social functions. The government is responsible for ensuring that every citizen’s right to health is fulfilled and for guaranteeing access to healthcare services as mandated by Article 28H paragraph (1) of the 1945 Constitution of the Republic of Indonesia.

In relation to access to healthcare services, Article 28H paragraph (3) of the 1945 Constitution stipulates that everyone is entitled to social security that enables the full development of their potential as useful members of society. One of the programs established to support this objective is the National Health Insurance (JKN), a form of social security regulated under Law No. 40 of 2004 on the National Social Security System (SJSN) and administered by the Social Security Agency for Health (BPJS Kesehatan).

Regarding the tiered referral system implemented by BPJS Kesehatan through its online referral system, several issues have arisen in practice, including patients’ concerns about the difficulty of obtaining referrals to appropriate advanced-level healthcare facilities. In principle, however, the referral system under BPJS Kesehatan has not changed. Instead, the system is intended to ensure that participants receive appropriate and quality healthcare services in accordance with the competencies of healthcare providers (Head of Public Relations at BPJS Kesehatan, M. Iqbal Anas Ma’ruf).

Meanwhile, under Article 32(g) of Law No. 44 of 2009 on Hospitals, one of the rights of patients is to choose their doctor and class of treatment according to their preferences and the applicable regulations at the hospital.

Through the National Health Law Seminar organized by the Master’s Program in Health Law, Faculty of Law, Universitas Gadjah Mada, in collaboration with the Majelis Pembina Kesehatan Umum PWM Muhammadiyah DIY, it is expected that the implications of the referral system in the JKN era for the fulfillment of patients’ rights can be examined and discussed in greater depth.
