FGD Criticizes the Land Bill
The Expertise Body of the House of Representatives of the Republic of Indonesia (DPR RI) and the Faculty of Law, Universitas Gadjah Mada (FH UGM) held a Focus Group Discussion (FGD) to critically examine the Land Bill (Rancangan Undang-Undang/RUU Pertanahan) on Thursday, 21 February 2019, at FH UGM. The FGD was divided into two sessions. The first session was moderated by Dr. Rikardo Simarmata, S.H., a lecturer in Agrarian Law at FH UGM. The speakers included FH UGM Professors Prof. Dr. Maria S.W. Sumardjono, S.H., M.CL., M.P.A. and Prof. Dr. Nurhasan Ismail, S.H., M.Si.; Chair of the DPR RI Working Committee on the Land Bill, Dr. Ir. H.E. Herman Khaeron, M.Si.; Secretary General of the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency, Himawan Arief Sugoto; Director General of Forestry Planning and Environmental Governance, Prof. Dr. Ir. Sigit Hardwinarto, M.Agr.; Head of the National Land College in Yogyakarta, Dr. Ir. Senthot Sudirman, M.S.; and Secretary General of the Ministry of Agriculture, Syukur Irwanto.
The second session was moderated by Dr. Inosentius Samsul, S.H., M.Hum., Head of the Center for Legislative Drafting at the DPR RI Expertise Body. Speakers in this session included Dr. Kurnia Warman, S.H., M.Hum., a lecturer in Agrarian Law at the Faculty of Law, Universitas Andalas; Dr. H. Suhajar Diantori, M.Si., Expert Staff to the Minister of Home Affairs for Government Affairs; Ir. I Gde Wayan Samsi Gunarta, M.Appl., Head of the Land Acquisition Facilitation Division of the Ministry of Public Works and Housing’s BPIW; Tini Martini, S.H., M.Soc.Sci., Head of the Legal and Organizational Bureau of the Ministry of Marine Affairs and Fisheries; and Julius Purnawan, S.H., M.Si., Chairman of the Association of Land Deed Officials (IPPAT).
Several crucial aspects of the Land Bill were examined during the FGD, including Customary Land Rights (Hak Ulayat) of Indigenous Communities and Land Rights for Foreign Citizens and Foreign Legal Entities. The discussion also covered the proposed duration of Cultivation Rights (Hak Guna Usaha), Building Rights (Hak Guna Bangunan), and Use Rights (Hak Pakai), as well as the possibility of establishing a Land Bank and a Land Court.
