Rector of Universitas Megoupak Lampung Earns Doctorate at FH UGM

Agus Marzuki, S.H., M.Hum., undertook his doctoral promotion examination on Thursday, March 31, 2016. The doctoral student of the Faculty of Law UGM, supervised by Prof. Dr. Marsudi Triatmodjo, S.H., LL.M., and Prof. Dr. Sudjito, S.H., M.Si., defended his dissertation entitled “Resolution of Tenurial Conflicts in the Register 45 Forest Area of Mesuji, Lampung from the Perspective of Justice.”

During the examination held in Room III.1.1 of FH UGM, the Rector of Universitas Megoupak Lampung explained that the tenurial conflict in the Register 45 forest area of Mesuji, Lampung, originated from disputes over control of the forest area between permit holders and the emergence of encroaching communities occupying the forest land. These encroaching communities consisted of people from Java, Bali, Palembang, Makassar, and parts of the Lampung community.

The meaning of “tenurial” in this dissertation refers to a conflict with multiple dimensions. The issues surrounding the Register 45 forest area in Mesuji are highly complex, leading the author to conclude that a holistic approach is required to resolve the problem. This holistic approach differs from the conventional approaches previously undertaken by the government. The conventional approach refers to one that views the issue from only a single perspective, whereas the holistic approach employs a broader and more comprehensive perspective while emphasizing justice for all parties involved.

Agus Marzuki, S.H., M.Hum., proposed several concepts for resolving the conflict, including the use of a holistic paradigm, responsive and progressive law that coherently integrates the substance, structure, and legal culture of society in a fair manner, the reflection of conflict resolution through partnership models, and the reflection of Administrative High Court (PTUN) decisions concerning disputes over the revocation of permits in the Register 45 forest area of Mesuji.

Almost all examiners expressed appreciation for the research conducted by the scholar born in the 1980s, considering it a very rare and valuable study. After the one-hour open examination concluded, the Board of Examiners chaired by the Dean of FH UGM, Prof. M. Hawin, S.H., LL.M., Ph.D., announced the academic distinction awarded to the new doctoral graduate. As the 123rd doctoral graduate of FH UGM and the 2,115th doctoral graduate of UGM, he was awarded the distinction of cum laude for his academic and research achievements during his doctoral studies at the Faculty of Law UGM.
