{"id":7315,"date":"2018-04-27T09:27:18","date_gmt":"2018-04-27T02:27:18","guid":{"rendered":"https:\/\/law.ugm.ac.id\/?p=2375"},"modified":"2018-04-27T09:27:18","modified_gmt":"2018-04-27T02:27:18","slug":"pusat-kajian-hukum-adat-djojodigoeno-mengadakan-diskusi-pengaturan-hak-hak-masyarakat-hukum-adat","status":"publish","type":"post","link":"https:\/\/law.ugm.ac.id\/en\/pusat-kajian-hukum-adat-djojodigoeno-mengadakan-diskusi-pengaturan-hak-hak-masyarakat-hukum-adat\/","title":{"rendered":"Djojodigoeno Center for Customary Law Studies Holds Discussion on the Regulation of Indigenous Peoples\u2019 Rights"},"content":{"rendered":"<p><a href=\"https:\/\/law.ugm.ac.id\/wp-content\/uploads\/sites\/9\/sites\/1043\/2018\/04\/Rilis-Berita_Djojodiguno-RUU-MHA-2.jpeg\" rel=\"attachment wp-att-2377\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-2377\" src=\"https:\/\/law.ugm.ac.id\/wp-content\/uploads\/sites\/9\/sites\/1043\/2018\/04\/Rilis-Berita_Djojodiguno-RUU-MHA-2.jpeg\" alt=\"Rilis Berita_Djojodiguno RUU MHA 2\" width=\"1185\" height=\"667\" \/><\/a><\/p>\n<p><strong>Pusat Kajian Hukum Adat Djojodigoeno Mengadakan Diskusi Pengaturan Hak-Hak Masyarakat Hukum Adat dalam Berbagai RUU<\/strong><\/p>\n<p>On Monday, 23 April 2018, the Djojodigoeno Center for Customary Law Studies at the Faculty of Law, Universitas Gadjah Mada (FH UGM), held a discussion entitled \u201cRegulation of Indigenous Peoples\u2019 Rights in Various Bills\u201d at the Sekip Room, Gadjah Mada University Club.\nThe discussion was prompted by the ongoing deliberation of several bills containing provisions related to the rights of indigenous peoples. These included: (1) the Bill on the Recognition and Protection of Customary Law Communities (RUU PPHMHA), (2) the Land Bill, (3) the Bill on Biodiversity Conservation, (4) the Mineral and Coal Bill, (5) the Oil Palm Plantation Bill, and (6) the Forestry Bill.\nApart from the RUU PPHMHA, these bills primarily address indigenous peoples\u2019 rights in relation to natural resources. Meanwhile, the RUU PPHMHA also covers other rights, including spiritual rights and the right to maintain cultural identity. The ongoing discussion of these six bills presents challenges in terms of the substance of their provisions. Overlapping regulations concerning the rights and existence of indigenous peoples, largely resulting from a dominant sectoral approach, require serious attention.<\/p>\n<p class=\"translation-block\">In addition to providing an update on the bills concerning the rights of customary law communities, the event was also held to commemorate the 75th birthday of Prof. Dr. Maria S.W. Sumardjono, S.H., MCL, MPA., a professor at FH UGM who has long been actively engaged in the study and discussion of Agrarian Law, Natural Resources, and Indigenous Peoples\u2019 Rights.\nDuring the event, Prof. Maria S.W. Sumardjono explained that there was common ground among the bills proposed by the House of Representatives (DPR), the Regional Representatives Council (DPD), and the Alliance of Indigenous Peoples of the Archipelago (AMAN). All of these bills seek to provide legal certainty regarding the recognition and respect of indigenous peoples\u2019 rights as legal subjects. To establish an effective mechanism for recognition and protection, the three bills need to be harmonized with one another.<\/p>\n<p>In addition to Prof. Maria S.W. Sumardjono, the discussion featured Prof. Dr. Hariadi Kartodihardjo, Noer Fauzi Rachman, Ph.D., and Dr. Kurnia Warman, S.H., M.Hum. The three speakers shared their experiences and perspectives on the evolving issues surrounding indigenous peoples\u2019 rights.\nThrough this event, the Djojodigoeno Center for Customary Law Studies at FH UGM hoped that the various parties involved in drafting bills concerning indigenous peoples\u2019 rights could develop a shared understanding of the substance of the regulations.
