Nafsiatun, S.H., M.Hum., successfully defended her dissertation in an Open Doctoral Promotion Examination held on Wednesday (21\/12) in Room 3.1.1, FH UGM. Her dissertation was entitled \u201cA Model for Addressing the Impacts of Gold Mining on the Environment and Communities in West Kalimantan Province.\u201d Prof. Dr. Marsudi Triadmodjo, S.H., LL.M., served as her promotor.<\/p>\n

Nafsiatun\u2019s dissertation examined conflict resolution arising from the impacts of mining activities. In the background of her study, she noted that government policies on the designation of mining areas had often overlooked local communities. Communities affected by the negative impacts of mining area designations should be consulted and given appropriate compensation. \u201cIndigenous communities there have their own local wisdom. When conflicts arise, they are resolved through customary mechanisms, which can provide a greater sense of justice than court proceedings,\u201d explained the lecturer of Environmental Law at Tanjungpura University.<\/p>\n

She proposed a new conflict-resolution model called \u201cCommunicative Tripartite,\u201d involving the government, local communities, and mining companies. The model places communities and the government on an equal footing to ensure balanced communication. The Communicative Tripartite model is based on local wisdom. She identified the disregard for local characteristics by mining companies as one of the causes of ongoing conflicts. \u201cThe existing Tripartite model tends to place communities in a position where they simply receive and accept decisions,\u201d Nafsiatun explained.<\/p>\n

Dean of FH UGM Prof. Dr. Sigit Riyanto, S.H., LL.M., chaired the examination as head of the panel. The other examiners were Dr. Supriyono, S.H., M.Si.; Dr. Sulastriyono, S.H., M.Si.; Dr. Djoko Sukisno, S.H., C.N.; Dr. Sutanto, S.H., M.Si.; and Prof. Dr. Ari Hermawan, S.H., M.Hum. The examination also featured a guest examiner from Universitas Sebelas Maret (UNS), Dr. I Gusti Ayu Ketut R. Yani, S.H., M.M.<\/p>\n

Nafsiatun hopes that her proposed model can serve as a reference for resolving disputes in other districts with similar characteristics. She plans to present the model to local governments as a basis for drafting regional regulations. In the future, she hopes that such regulations will incorporate the values of customary law.<\/p>\n
