On that occasion, the lecturer from the Faculty of Law at Universitas Islam Bandung defended his dissertation entitled Competition Law Analysis of the Practices of Collective Management Organizations (CMOs) in Indonesia.<\/p>\n<p style=\"text-align: justify\">The doctoral promotion examination lasted approximately two hours and featured questions from eight examiners, including Prof. Dr. Nindyo Pramono, S.H., M.S., who served as Promotor, and Prof. M. Hawin, S.H., LL.M., Ph.D., who served as Co-Promotor.<\/p>\n<p style=\"text-align: justify\" class=\"translation-block\">During the examination, the Promotor raised a question regarding one of the concepts discussed in the dissertation. \u201cYour dissertation states that the blanket license mechanism is used by Collective Management Organizations (CMOs) when offering licenses for the use of musical works. What exactly does blanket license mean in this context?\u201d he asked.\nArvie explained that a blanket license refers to the consolidation of all licenses managed and granted by a CMO. CMOs are authorized to manage the economic rights associated with copyrighted songs and, through this authority, combine multiple permissions into a single licensing package offered to music users. He further explained that the blanket license system operates alongside a licensing tariff scheme, where fees are calculated not on a per-song basis but according to the revenue-generating potential of the user. For example, in the case of a karaoke business, factors such as the number of rooms, room size, and average number of customers would be taken into account.<\/p>\n<p style=\"text-align: justify\" class=\"translation-block\">The Promotor also inquired about the relationship between blanket licenses and competition law. Arvie responded by explaining that the essence of competition law lies in achieving allocative efficiency. \u201cThe focus should be on the demand side because markets emerge from demand rather than supply,\u201d he noted. In the context of CMOs, the use of blanket licenses does not provide users with the option to purchase licenses on an individual-song basis or on a per-program basis. As a result, allocative efficiency is not achieved. Music users with limited licensing needs may be required to pay for access to thousands of songs included in a package, even though they may only need around one hundred songs. Consequently, such users incur unnecessary costs.\nTo address this issue, Arvie recommended that CMOs offer a wider range of licensing options, including blanket licenses, program-specific licenses, and individual-song licenses.<\/p>\n<p style=\"text-align: justify\">In his dissertation, the Klaten-born scholar also proposed several recommendations for improving the practices of Collective Management Organizations in Indonesia. First, he suggested that the relationship between CMOs and songwriters should be centered on the copyrighted works themselves, allowing creators the freedom to register their songs with whichever CMO best suits their needs and preferences. Second, he proposed that royalty distribution formulas should be based on the number of songs registered by each songwriter, thereby providing incentives for creators to produce more works and register them with CMOs.\nThrough these findings and recommendations, Arvie\u2019s research contributes to the development of competition law and intellectual property governance in Indonesia, particularly in relation to the management of music copyrights and royalty distribution.
