{"id":43694,"date":"2026-07-14T10:34:21","date_gmt":"2026-07-14T03:34:21","guid":{"rendered":"https:\/\/law.ugm.ac.id\/?p=43694"},"modified":"2026-09-09T14:23:12","modified_gmt":"2026-09-09T07:23:12","slug":"mendorong-pemahaman-masyarakat-mengenai-perjanjian-perkawinan-sebagai-instrumen-perlindungan-hukum-melalui-program-pro-justicia-tvri-yogyakarta","status":"publish","type":"post","link":"https:\/\/law.ugm.ac.id\/en\/mendorong-pemahaman-masyarakat-mengenai-perjanjian-perkawinan-sebagai-instrumen-perlindungan-hukum-melalui-program-pro-justicia-tvri-yogyakarta\/","title":{"rendered":"Promoting Public Understanding of Prenuptial Agreements as a Legal Protection Instrument Through the Pro Justicia Program on TVRI Yogyakarta"},"content":{"rendered":"<p><span style=\"font-weight: 400\">The Legal Consultation and Assistance Centre (Pusat Konsultasi dan Bantuan Hukum\/PKBH) of the Faculty of Law, Universitas Gadjah Mada, in collaboration with TVRI Yogyakarta, held a legal outreach session through the Pro Justicia program under the theme \"Prenuptial Agreements: A Sign of Distrust Toward One's Partner, or a Form of Legal Protection?\", at the TVRI Yogyakarta Studio, Jalan Magelang, Sleman Regency, Yogyakarta Special Region, on Tuesday, July 14, 2026. Running from 10:45 a.m. to 1:00 p.m. WIB, the session aimed to provide the public with a comprehensive understanding of the legal position, function, and urgency of prenuptial agreements as a legal protection instrument within married life.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The session featured three resource persons: Djoko Wiryono Budhi Sarwoko, S.H., a Judge of the Yogyakarta District Court; Dita Elvia Kusuma Putri, S.H., M.Kn., a doctoral candidate at the Doctoral Program in Legal Studies, UGM Faculty of Law; and Puspaningtyas Panglipurjati, S.H., LL.M., a Civil Law Lecturer at the Faculty of Law, Universitas Atma Jaya Yogyakarta, and also a doctoral candidate at the UGM Faculty of Law.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In her presentation, Puspaningtyas Panglipurjati explained that a prenuptial agreement (perjanjian perkawinan) is an agreement made by prospective spouses, or by a husband and wife already married, to regulate specific legal consequences within the marriage in accordance with the applicable laws and regulations. She outlined the function of a prenuptial agreement as an instrument providing legal certainty regarding the rights and obligations of the parties particularly in relation to the management of marital assets. She also discussed the regulatory developments governing prenuptial agreements in Indonesia, including the changes brought about by Constitutional Court Decision No. 69\/PUU-XIII\/2015, which opened the door for couples to conclude a prenuptial agreement not only before the marriage, but also during the course of the marriage. She further emphasized that the existence of a prenuptial agreement can provide legal certainty for the parties to the marriage, as well as for third parties who have a legal relationship with them.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Dita Elvia Kusuma Putri then explained that the drafting of a prenuptial agreement must observe the limitations set by law. Clauses included in the agreement must not contravene applicable laws and regulations, public morality, or public order. She explained that a prenuptial agreement must be concluded in accordance with proper legal procedure in order to be legally binding  including with regard to its registration, amendment, or revocation. She noted that while the principle of freedom of contract (asas kebebasan berkontrak) applies in the drafting of prenuptial agreements, this freedom is not absolute and remains constrained by the applicable legal provisions in order to protect the parties as well as third parties.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Djoko Wiryono Budhi Sarwoko addressed the practice of resolving marital property disputes in court where a prenuptial agreement is involved. He explained that the existence of a prenuptial agreement may serve as a basis for the judge's consideration in deciding a case, provided the agreement was validly concluded and complies with the applicable legal provisions. He also outlined the legal consequences that arise when one party breaches the prenuptial agreement, as well as the various problems that commonly surface in marital property disputes including cases involving third-party interests, such as creditors. In judicial practice, he noted, a judge does not only consider the interests of the parties to the marriage, but also extends legal protection to third parties who have a legal relationship with the marital property.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The legal outreach session was attended by 15 participants from Universitas Gadjah Mada and Universitas Atma Jaya Yogyakarta. Participants not only received presentations from the resource persons, but were also given the opportunity to engage in direct discussion and to raise questions about various legal issues relating to prenuptial agreements making the session highly interactive throughout.<\/span><\/p>\n<p><span style=\"font-weight: 400\">As part of the effort to broaden access to legal education for the wider public, the talkshow was subsequently broadcast on the TVRI Yogyakarta television channel and live-streamed on the TVRI Yogyakarta YouTube channel on Tuesday, July 28, 2026, at 3:00 p.m. WIB, enabling it to reach a much wider audience.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Through this legal outreach session, it is hoped that the public will come away with a more comprehensive understanding of prenuptial agreements as an instrument of legal certainty and protection for both spouses.
