{"id":41843,"date":"2026-04-24T08:48:29","date_gmt":"2026-04-24T01:48:29","guid":{"rendered":"https:\/\/law.ugm.ac.id\/?p=41843"},"modified":"2026-04-27T08:57:54","modified_gmt":"2026-04-27T01:57:54","slug":"pandekha-fh-ugm-bersama-wgii-gelar-studium-generale-dan-diseminasi-hasil-eksaminasi-publik-putusan-mahkamah-konstitusi-terkait-uu-ksdahe","status":"publish","type":"post","link":"https:\/\/law.ugm.ac.id\/en\/pandekha-fh-ugm-bersama-wgii-gelar-studium-generale-dan-diseminasi-hasil-eksaminasi-publik-putusan-mahkamah-konstitusi-terkait-uu-ksdahe\/","title":{"rendered":"PANDEKHA FH UGM and Working Group ICCAs Indonesia Host Studium Generale and Dissemination of Public Examination of Constitutional Court Decision on the Biodiversity Conservation Law (UU KSDAHE)"},"content":{"rendered":"<p class=\"translation-block\">The Centre for Democracy, Constitutional Law, and Human Rights at the UGM Faculty of Law (PANDEKHA FH UGM), in collaboration with the Working Group ICCAs Indonesia (WGII), organized an event titled \"Studium Generale and Dissemination of the Results of the Public Examination of the Constitutional Court Decision in the Formal Review of the Law on the Conservation of Biological Natural Resources and Their Ecosystems (UU KSDAHE)\". The event proceeded smoothly and was well received by participants. It was held on Friday, April 24, 2026, in-person at Building III of the UGM Faculty of Law and simultaneously online via Zoom, reaching a broad and diverse audience.<\/p>\n\n\n\n<p class=\"translation-block\">The event was organized as an academic and advocacy response to Constitutional Court Decision No. 132\/PUU-XXII\/2024, which rejected the petition for a formal review of UU KSDAHE. The ruling has raised public concern, as it is seen as opening space for the legitimization of non-participatory legislative practices  -  potentially sidelining the interests of vulnerable groups, particularly Indigenous Peoples and local communities.<\/p>\n\n\n\n<p class=\"translation-block\">The public lecture was delivered by Prof. Enny Nurbaningsih, S.H., M.Hum., Justice of the Constitutional Court of the Republic of Indonesia, under the theme \"The Constitution, Human Rights, and the Governance of Natural Resources\". Prof. Enny emphasized that this forum is part of a constitutional dialogue  -  not a space for defending or justifying any particular decision. She also stressed that the natural environment must be understood as part of the constitutional regime through the principle of environmental constitutionalism, and that the governance of natural resources must therefore be oriented toward sustainability, human rights, and intergenerational justice.<\/p>\n\n\n\n<p class=\"translation-block\">The dissemination session opened with a presentation by Aji Baskoro, S.H., Program Manager of PANDEKHA FH UGM and a member of the Examination Writing Team. He presented the view that the legislative process for UU KSDAHE suffered from serious shortcomings in terms of openness and meaningful public participation  -  including the predominance of closed-door meetings and the Constitutional Court's inconsistency in applying the standard of meaningful participation.<\/p>\n\n\n\n<p class=\"translation-block\">Cindy Julianty, Executive Coordinator of WGII, emphasized the importance of a rights-based approach to conservation. She argued that indigenous peoples and local communities must not be positioned merely as stakeholders  --  they must be recognized as rights-holders, with rights over land, territory, natural resources, traditional knowledge, and full participation in decision-making.<\/p>\n\n\n\n<p>Meanwhile, Nabiyla Risfa Izzati, S.H., LL.M. (Adv)., Ph.D., emphasized that the protection of migrant workers constitutes a state responsibility in guaranteeing the fundamental rights of citizens. She stressed the importance of understanding employment contracts, wage transparency, and the prohibition against withholding personal documents as essential components of legal protection.<strong> Cindy Julianty<\/strong>, Executive Coordinator WGII, menegaskan pentingnya pendekatan konservasi berbasis hak atau <em>rights-based conservation<\/em>. Menurutnya, masyarakat adat dan komunitas lokal tidak boleh hanya diposisikan sebagai <em>stakeholders<\/em>, melainkan sebagai <em>rights-holders<\/em> yang memiliki hak atas tanah, wilayah, sumber daya alam, pengetahuan tradisional, serta partisipasi penuh dalam pengambilan keputusan.<\/p>\n\n\n\n<p class=\"translation-block\">Complementing the discussion, I Gusti Agung Made Wardana, S.H., LL.M., Ph.D., an academic at FH UGM, offered a political ecology perspective on UU KSDAHE. He critiqued the concept of preservation zones and the Western conservation paradigm that separates human beings from nature. In his view, UU KSDAHE is not only procedurally flawed  --  it also carries epistemological problems by failing to acknowledge the historical, cultural, and ecological relationships between indigenous peoples and their living spaces.<\/p>\n\n\n\n<p class=\"translation-block\">The event has strategic relevance in supporting the achievement of the Sustainable Development Goals (SDGs)  -  particularly SDG 13 (Climate Action), SDG 15 (Life on Land), and SDG 16 (Peace, Justice and Strong Institutions). The discourse on natural resource governance, environmental protection, and the strengthening of meaningful public participation are key elements in realizing inclusive and just sustainable development. The forum contributes not only to academic scholarship, but also serves as an important space for driving policy reform in line with the global sustainability agenda.<\/p>\n\n\n\n<p>Through this event, PANDEKHA FH UGM and WGII hope that the public examination results will not remain merely an academic document, but will serve as a strategic foundation for policy advocacy  -  including potential material review proceedings and the improvement of derivative regulations.
