{"id":34896,"date":"2025-07-21T13:40:53","date_gmt":"2025-07-21T06:40:53","guid":{"rendered":"https:\/\/law.ugm.ac.id\/?p=34896"},"modified":"2025-07-28T13:42:47","modified_gmt":"2025-07-28T06:42:47","slug":"angkat-topik-yurisdiksi-internasional-dalam-perkara-perdata-sujayadi-raih-gelar-doktor-dari-fakultas-hukum-ugm","status":"publish","type":"post","link":"https:\/\/law.ugm.ac.id\/en\/angkat-topik-yurisdiksi-internasional-dalam-perkara-perdata-sujayadi-raih-gelar-doktor-dari-fakultas-hukum-ugm\/","title":{"rendered":"Focusing on the Topic of International Jurisdiction in Civil Cases, Sujayadi Earns a Doctorate from the UGM Faculty of Law"},"content":{"rendered":"<p>On Monday (July 21, 2025), Sujayadi, S.H., LL.M., successfully defended his dissertation titled \u201cPersonal Jurisdiction of Indonesian Courts in International Civil Litigation: Issues of Jurisdiction and the Recognition and Enforcement of Foreign Court Judgments.\u201d The supervisory committee consisted of Prof. Dr. Tata Wijayanta, S.H., M.Hum., and Co-Supervisor Herliana, S.H., LL.M., Ph.D. The examining committee consisted of Dahliana Hasan, S.H., M.Tax., Ph.D., as chair of the examiners, and Prof. Dr. Ari Hernawan, S.H., M.Hum., Irna Nurhayati, S.H., M.Hum., LL.M., Ph.D., Dr. Ninik Darmini, S.H., M.Hum., and Prof. Dr. Efa Laela Fakhriah, S.H., M.H., as members of the examination committee.&nbsp;<\/p>\n\n\n\n<p>The dissertation researched by Sujayadi, S.H., LL.M., focuses on identifying the concept of personal jurisdiction and the principles used in determining a court\u2019s personal jurisdiction. This research also evaluates the current Indonesian legal provisions governing the resolution of international civil cases, particularly in the context of cross-border litigation. Additionally, the dissertation analyzes legal policies regarding the recognition and enforcement of foreign court judgments in Indonesia, and proposes a legal framework that could be implemented in the future to enhance legal certainty within the Indonesian judicial system.<\/p>\n\n\n\n<p class=\"translation-block\">In his dissertation, Sujayadi, S.H., LL.M., explains that personal jurisdiction is a form of the exercise of state sovereignty in enforcing the law against the parties to a case. The fundamental principle of this jurisdiction rests on the existence of real and substantial connections (<em>the real and substantial connections<\/em>) between the forum and the defendant or between the forum and the subject matter of the case. Article 118 of the HIR\/ Article 142 RBg, which currently serve as the basis for personal jurisdiction in Indonesian courts, actually incorporate several universal principles; however, according to Sujayadi, they need to be supplemented with the principle of <em>forum solutionis<\/em> for contract disputes and the principle of <em>forum loci delicti commissi<\/em> or <em>forum loci damni<\/em> for cases involving torts. Meanwhile, Article 100 of the Rv is considered still relevant, but it is recommended that it be modified to <em>forum necessitatis<\/em> to address the need for residual jurisdiction.<\/p>\n\n\n\n<p class=\"translation-block\">Furthermore, Sujayadi highlighted legal policies regarding the recognition and enforcement of foreign court judgments in Indonesia. This is done through the interpretation of Article 436 of the Civil Code in the context of Article 22a of the Civil Code, which requires the principle of reciprocity based on international agreements so that the recognition and enforcement of judgments can be carried out on a reciprocal basis. However, research findings indicate that this principle of reciprocity has been abandoned in a number of countries or applied more flexibly through the approach of <em>de jure reciprocity<\/em>. Additionally, other requirements for the recognition and enforcement of foreign judgments suggest a trend toward the convergence of international legal systems.<\/p>\n\n\n\n<p>For successfully defending his dissertation, Sujayadi, S.H., LL.M. officially received his doctoral degree from the UGM Faculty of Law with the grade of A-.  With this, Dr. Sujayadi, S.H., LL.M. becomes the 273rd doctoral graduate to pass the examination at the Faculty of Law, UGM, and the 6,523rd doctoral graduate to graduate from Gadjah Mada University.<\/p>\n\n\n\n<p class=\"translation-block\">Sujayadi\u2019s success reflects the commitment of the UGM Faculty of Law to realizing <em>the Sustainable Development Goals (SDGs)<\/em>, particularly <strong>Goal 4<\/strong> on <em>Quality Education<\/em> and <strong>Goal 16<\/strong> on <em>Strong and Just Institutions<\/em>. This dissertation not only makes an academic contribution to the development of international civil law in Indonesia but also strengthens the national legal system through a rigorous scientific approach.
