M., from the Department of Criminal Law, testified as experts in the judicial review hearing of Law No. 28 of 2014 on Copyright at the Constitutional Court. The case is registered under Number 28\/PUU-XXIII\/2025 and was filed by creators and singers affiliated with the One Vision Movement, including Tubagus Arman Maulana and Nazril Ilham, with Panji Prasetyo, S.H., LL.M., MCIArb., ANZIIF serving as the lead counsel.<\/p>\n\n\n\n<p>In her statement, Laurensia Andrini highlighted the controversy surrounding differing interpretations of Article 9, paragraphs (2) and (3), and Article 23, paragraph (5) of the Copyright Law, which pertain to the central question: \u201cDo performers need to obtain permission from the creators before performing their songs?\u201d According to Laurensia, based on Article 23(5), performers are not required to seek prior permission as long as royalties are paid to the Collective Management Organization (CMO). Furthermore, Laurensia also emphasized the importance of a one-stop royalty management system to ensure legal certainty and efficiency in protecting the economic rights of creators and performers, particularly in the entertainment industry. Laurensia\u2019s involvement reflects the strategic role of academics in strengthening the intellectual foundation and fairness in the regulation of intellectual property rights.<\/p>\n\n\n\n<p class=\"translation-block\">Meanwhile, Akbar highlighted the criminal penalties outlined in Article 113(2) of the Copyright Law. He emphasized that criminalizing performers suspected of copyright infringement does not necessarily meet the threshold of social harm warranting criminalization (the social cost of crime). According to Akbar, resolution through civil and administrative channels via the LMK is preferred, to maintain a balance between legal protection and freedom of expression in the arts. Unfortunately, the principle of ultimum remedium enshrined in Article 95(4) is overly formalistic and does not sufficiently emphasize that criminal prosecution should be a last resort.<\/p>\n\n\n\n<p class=\"translation-block\">The involvement of UGM Law Faculty lecturers in the process of reviewing this law aligns with the Sustainable Development Goals (SDGs), particularly Goal 16 on Peace, Justice, and Strong Institutions. Efforts to strengthen legal justice and protection of intellectual property rights through academic engagement demonstrate a commitment to building an inclusive, transparent, and accountable legal system.
