{"id":33988,"date":"2025-05-06T13:29:11","date_gmt":"2025-05-06T06:29:11","guid":{"rendered":"https:\/\/law.ugm.ac.id\/?p=33988"},"modified":"2025-05-08T14:19:46","modified_gmt":"2025-05-08T07:19:46","slug":"eksaminasi-publik-putusan-ma-soal-suku-awyu-sorotan-atas-keadilan-substantif-hak-adat-dan-krisis-ekologis-papua","status":"publish","type":"post","link":"https:\/\/law.ugm.ac.id\/en\/eksaminasi-publik-putusan-ma-soal-suku-awyu-sorotan-atas-keadilan-substantif-hak-adat-dan-krisis-ekologis-papua\/","title":{"rendered":"Public Examination of the Supreme Court Ruling on the Awyu Tribe: Spotlight on Substantive Justice, Customary Rights, and Papua's Ecological Crisis"},"content":{"rendered":"<p>On Friday (May 2, 2025), the Center for Law and Social Justice Studies (LSJ) of the Faculty of Law, Universitas Gadjah Mada (UGM), Greenpeace Indonesia, and Pusaka Bentala Rakyat held a \"Public Examination of Decision 458 K\/TUN\/LH\/2024 on the Awyu Tribe Case.\" The examination featured W. Riawan Tjandra, Yulia Sugandi, Rikardo Simarmata, Agung Wardana, and Herlambang P. Wiratraman as examiners, moderated by Franky Butar-Butar. The event opened with a special welcome from Kaleb Salamuk, a student at the Faculty of Economics and Business, Universitas Gadjah Mada, who examined the meaning of #AllEyesonPapua.<\/p>\n\n\n\n<p>W. Riawan Tjandra, a Public Administrative Law expert from Atma Jaya University Yogyakarta, observed that the a quo Decision actually emphasized formal justice, leading to practical invalidation. Riawan instead sought to ensure that the a quo Decision prioritized substantive justice, thereby eliminating formal issues during the lawsuit. One of Riawan's points to the emphasis on formal justice, which is the inaccuracy in analyzing the causal relationship between AMDAL procedures and the quality of State Administrative Court (TUN) decisions, resulting in the failure to achieve the goal of achieving material truth. \"As a result, the PTUN has failed to carry out its primary function of providing justice,\" Riawan said.<\/p>\n\n\n\n<p>\"In the name of development, the existence of indigenous peoples in Papua has been marginalized,\" said Yulia Sugandi, an anthropologist at the Bogor Agricultural University (IPB). According to Yulia, systemic transformation of Papua's ecological conditions requires overhaul of perspectives, structures, and practices. Without this, Papua's biocultural diversity is threatened. Therefore, the development model in Papua should not be solely driven by profit; it needs an <em>ethnodevelopment <\/em>(pembangunan berbasis identitas)<em>.<\/em> orientation (identity-based development). Continuing from her previous point, Yulia stated that <em>ethnodevelopment <\/em>needs to be supported by the decolonization of knowledge and socio-democratic change. The consequences of this development will result in justice across national borders, across generations, and across non-humans.<\/p>\n\n\n\n<p>Meanwhile, Rikardo Simarmata, an expert in agrarian and customary law from the Faculty of Law, Universitas Gadjah Mada, stated that the Supreme Court Decision No. 458 K\/TUN\/LH\/2024 fails to consider substantive aspects; it focuses solely on formal matters. At the same time, the ruling invalidates the application of laws and regulations on Special Autonomy (Otsus). \"In fact, the Papuan Special Autonomy, legitimized by Law 2\/2021 and subsequent special regional regulations (Perdasus), has formulated the recognition of MHA,\" Simarmata said. Therefore, customary rights lack legitimacy and can easily be claimed as state land or forests. One of Simarmata's recommendations to the government is to recognize MHA as existing due to socio-anthropological realities, not formal ones.<\/p>\n\n\n\n<p>Agung Wardana, an environmental law expert from the Faculty of Law, Universitas Gadjah Mada (UGM), emphasized the need to examine the environmental legal framework in the Awyu Tribe case. The a quo cassation ruling actually justifies the previous PTUN ruling, which provided a sound basis for forest conversion within the Awyu Tribe's Indigenous Community area. The implication, according to Wardana, is that the ruling completely failed to consider the principles of intergenerational justice, sustainable development, and environmental hazard prevention. Furthermore, Wardana stated that the Supreme Court panel of judges tended to play it safe by not wanting to engage further in the environmental debate and not fulfilling its judicial activism role.<\/p>\n\n\n\n<p>On the other hand, Herlambang P. Wiratraman, an expert in constitutional law from the Faculty of Law, Universitas Gadjah Mada (UGM), highlighted the aspect of citizens' constitutional rights. Herlambang emphasized the focus on the rights of indigenous peoples (MHA), which are constitutional rights of citizens recognized in Article 18B paragraph (2) in conjunction with Article 18B paragraph (2). Article 28I paragraph (3) of the 1945 Constitution of the Republic of Indonesia. Specifically, in the Jayapura Administrative Court Decision, the constitutional rights of Indigenous Peoples (MHA) were violated, including the loss of food sources and communal ties. Furthermore, participation appears to be absent in the exploitation policy for oil palm plantations. This lack of participation certainly fails to fulfill the guarantees stipulated in Article 28F of the 1945 Constitution, Article 42 (3), and Law 2\/2021.&nbsp;<\/p>\n\n\n\n<p>The examiners believe that the courts need to prioritize substantive justice over formal justice by considering the socio-anthropological aspects of indigenous peoples and their constitutional rights, recognizing the existence of Indigenous Law Communities (MHA) based on social and cultural realities, and adhering to the principles of intergenerational justice, sustainable development, and environmental protection. Furthermore, a shift in development paradigms is needed that prioritizes ethnodevelopment and the decolonization of knowledge, and ensures the active participation of indigenous peoples in decision-making regarding the management of natural resources in their territories.
