Dr. Khotibul Umam, S.H., LL.M., the Secretary from Doctoral Law Study Program Faculty of Law UGM and Lecturer from Islamic Law Department Faculty of Law UGM had an opportunity to act as the External Examiner for the Dissertation Defense of Ahmad Fadhly Roza, a Doctoral Law Student from Faculty of Law State Islamic University of North Sumatra (UIN Sumatra Utara). This dissertation defense was conducted on Monday (26\/8\/2024). The title for this dissertation entitled: \u201cReconstruction of the Indonesian Criminal Procedure Code (KUHAP) in Legal Remedies for Public Prosecutors: An Analysis Based on Maqasid al-Shariah,\" supervised by Prof. Dr. Pagar Hasibuan, M.A., and Dr. Arifuddin Muda Harahap, M.Hum.<\/p>\n\n\n\n
In this opportunity, Dr. Khotibul Umam asked a question regarding the objective of maqashid syariah that are to be achieved through the reconstruction of the Criminal Procedure Code (KUHAP) and the opportunities for its implementation in diverse Indonesia. Promovendus explained that the primary maslahat (daruriyat) that is about to achieve is the protection towards the life and property, which is the universal maslahat and applied for everyone, regardless of their belief. Promovendus convinced that maqashid syariah can be a reconstruction instrument to provide a legal line that can be applied universally for Indonesian citizens.<\/p>\n\n\n\n
This dissertation argued that the current Indonesian Criminal Procedure Code (KUHAP) have not yet accommodated the legal effort for Public Prosecutor, both the ordinary legal effort or the extraordinary legal effort. Ahmad Fadly emphasized the importance of the KUHAP reconstruction that related with the legal aid for the victim of violence in criminal justice system. He recommended for Article 67 KUHAP to be modified to provide rights for the victim to exercise their legal aid, in regards for the implementation of justice, certainty, and utility.<\/p>\n\n\n\n
This reconstruction is aligned with the maqashid syariah and aimed to implement the justice in the criminal justice system, therefore the fair relationship between the victim and the perpetrator can be fostered. This event is aimed to give a positive contribution to the legal development in Indonesia, especially in the context of the protection of the victim\u2019s right.<\/p>\n\n\n\n
