The defense was held on Monday, January 30, in Room 3.1.1. Prof. Dr. Ari Hernawan, S.H., M.Hum. served as Promotor, with Dr. Zainal Arifin Mochtar, S.H., LL.M. as Co-Promotor. The examining panel comprised Dr. Ninik Darmini, S.H., M.Hum., Richo Andi Wibowo, S.H., LL.M., Ph.D., Sri Wiyanti Eddyono, S.H., LL.M.(HR)., Ph.D., Prof. Dr. Ni'matul Huda, S.H., M.Hum., and Adrianto Dwi Nugroho, S.H., Adv.LL.M., LL.D. as Head of the Examining Panel.<\/p>\n<p><span style=\"font-weight: 400\">Imma explained that the legislative framework governing workers with disabilities requires harmonization. The legal instruments regulating disabled workers include Law No. 13 of 2003 on Manpower, Law No. 8 of 2016 on Persons with Disabilities, and Law No. 11 of 2020 on Job Creation. According to Imma, the three laws remain unharmonized when assessed against the concepts of non-discrimination, justice, and equality - principles that appear not to have been fully adopted in Law No. 13 of 2003 and Law No. 11 of 2020. Beyond this, both laws also remain unharmonized with relevant international conventions.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This lack of harmonization, she explained, stems from the fact that Law No. 13 of 2003 and Law No. 11 of 2020 were drafted primarily to serve economic and investment interests -- making their formation orthodox in nature, with the law functioning as a reflection of the social and political vision of those in power. Law No. 8 of 2016, by contrast, was enacted to provide human rights protection, with a more responsive drafting process and a legal function oriented toward fulfilling the human rights of persons with disabilities. For this reason, the dissertation positions Law No. 8 of 2016 as the guiding framework for harmonizing legislation related to disabled workers.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Imma added that, as a member of the international community, Indonesia should properly use international conventions as a legal foundation for drafting legislation. She noted that the concepts contained within international conventions can be readily accepted and adopted, and are not at odds with the nation's underlying philosophical values. \"The concept of equality and equal access to employment found in international conventions reflects the fifth principle of Pancasila - namely, justice\"<\/span><\/p>\n<p><span style=\"font-weight: 400\">Imma Indra Dewi Windajani, a lecturer at the Faculty of Law, Universitas Atma Jaya Yogyakarta, successfully defended her dissertation research and was awarded a final grade of A-.
