The law replaced Law No. 22 of 1957 on the Settlement of Labor Disputes, which was considered no longer responsive to developments in industrial society.<\/p>\n<p style=\"text-align: justify\">One of the mechanisms for resolving industrial relations disputes under Law No. 2 of 2004 is through the Industrial Relations Court (Pengadilan Hubungan Industrial\/PHI). However, the existence of the PHI has continued to draw criticism. Its limited accessibility has made time and cost major concerns for parties seeking dispute resolution.<\/p>\n<p style=\"text-align: justify\">Not every regency has an Industrial Relations Court, requiring parties to travel to the provincial level. Furthermore, when the parties are dissatisfied with a PHI decision, they must file an appeal with the Supreme Court, which means additional time is required before a final decision can be obtained. Unfortunately, not every decision can be effectively implemented because some lack sufficient sociological binding force.<\/p>\n<p style=\"text-align: justify\">\u201cWorkers and laborers want disputes to be resolved quickly. However, through the PHI, the process actually takes even longer,\u201d said Siti Kunarti, S.H., M.Hum., during her Open Doctoral Promotion Examination at the Faculty of Law, Universitas Gadjah Mada (FH UGM), on Tuesday (19\/7).<\/p>\n<p style=\"text-align: justify\" class=\"translation-block\">The lecturer at Universitas Jenderal Soedirman concluded in her dissertation, titled \u201cThe Existence of the Industrial Relations Court (PHI) within Indonesia\u2019s Judicial System,\u201d that the PHI is no longer necessary because it no longer corresponds to the philosophy underlying its establishment. She argued that industrial relations disputes could instead be resolved through non-litigation mechanisms, including bipartite negotiations, mediation, conciliation, and arbitration. These alternative dispute resolution mechanisms are expected to produce a win-win solution for the parties involved.<\/p>\n<p style=\"text-align: justify\">Nevertheless, Siti emphasized that the existence of the PHI is not entirely without purpose.
