    PUKAT Corruption UGM Pushes the Indonesian Supreme Court to Reform the Internal Institution

    Anti Corruption Research Centre (PUKAT) Faculty of Law UGM pushed the Indonesian Supreme Court (SC) to soon reform the internal institution and widely open to Judicial Commission (JC) as the external controller to control the performances of Supreme Court judges after the new Chairman of Supreme Court elected, Harifin A Tumpa (67).

    Two points above were explained by the director of PUKAT UGM Zainal Arifin Mochtar SH LLM, in his office, Bulaksumur Yogyakarta, Jumat (16/1). According to him, the internal reformation and let the JC to control the performances of the supreme court judges should be soon conducted by the new Chairman of Supreme Court to establish the integrity between the supreme judges and Supreme Court Institutions

    Although Zainal admitted that in next three years of Harifin’s period as the Chairman of Supreme Court, there  is no enough time for him to overcome the all cases and eradicate the judicature mafias, including at High Courts and District Courts

    "It happenend because the participation and the willingness of the society were ignored in determining the Chairman of SC. Old and young are not the matters, but what can we get from 67 years old?.” Zainal added.

    Meanwhile, a legal expert from Universitas Andalas, padang, Saldi Isra S.H. said that there were some miracles in internal institution of SC related to the cases’ decisions. From 2005-2008 there were 1.421 cases in SC and 659 of them were released free.

    It was more concerned saldi Isra said that most of the freed cases were corruption cases. Although it was so, the external controlling to SC was denied by 31 supreme court judges. All of them were together presenting the judicial review of Regulation No 4 year 2004 about judge authority and Regulation No 22 2004 about Judicial Commission (JC).

    "It means that the supreme court judge refused to be controlled by JC as the external controller” Said Saldi. He added that In fact, SC also refused the financial auditing of lawsuit conducted by Financial Investigation Bureau. Saldi thought that the regulation of additional time of age retire of Supreme Court judge until 70 years old was to save the enfeebled Supreme Court judge to keep stay in SC.
